APPLICABLE LAW AND JURISDICTION
The services provided on this website are subject to Spanish law. The parties, waiving their own jurisdiction, if possible, submit to the Courts and Tribunals of Barcelona (Spain).
GASTRON'HOME SL promotes third-party food products by offering on its website subscription formulas for monthly subscriptions of local boxes through its consulting services, selection, packaging and delivery of non-refrigerated gourmet food products which allows its customers to receive a box of gourmet products from different regions of France (hereinafter, "The Gourmet Box") and/or to buy the versions previous boxes offered by La Gourmet Box as well as individual themed boxes on its website.
To contract the products on the website, the Customer agrees to be bound by these Conditions and he fully understands and accepts the terms and conditions set out herein to use the site Web and contract the services and products offered there.
GASTRON'HOME operates via the Web (exclusively) for all of the countries listed in its Terms of Delivery (exclusively) and provides its Services for all of these countries, to the exclusion of all others.
GASTRON'HOME undertakes not to allow any transactions that are illegal, or deemed illegal by the credit card brands or the acquiring bank, that could or would have the potential to harm or negatively impact the goodwill of the latter. The following activities are prohibited under the credit card brand programs: the sale or offer of a product or service that does not fully comply with all laws applicable to the purchaser, the issuing bank, the merchant, the cardholder or the payment cards.

ESTABLISHMENT OF CONTRACT
The Contract between the Client and GASTRON'HOME (hereinafter the "Contract") will be executed once the Client has validated the order of the services by duly completing the fields necessary for the placing of the order and making the payment. Once the services have been ordered, the client will receive an order confirmation email confirming that GASTRON'HOME SL has received and accepted the order. However, you can modify your order before it enters the shipping process. The order implies the acceptance of these General Conditions of Sale. The Customer must verify that the data provided by him/her, and subsequently collected in the Order Confirmation, are accurate. GASTRON'HOME cannot be held responsible for any errors in the data provided by the user.
The Contract only covers the services that are the subject of the Order Confirmation. We do not undertake to provide any other services until they have been the subject of a separate Order Confirmation.
GASTRON'HOME allows the User to have periodic subscription to the service through a prepaid subscription (hereinafter referred to as the Prepaid Subscription), for periods of one (1), two (2), three (3) and six (6) months. By subscribing in prepaid mode, the Customer will make a single initial payment, for which he will receive as many boxes as the number of months contracted for this subscription service. At the end of the period for which the Prepaid Subscription service has been contracted, the Customer must subscribe again to continue receiving new boxes. Cancellation by the User of the Prepaid Subscription service before the end of the service will not give any right to reimbursement of the proportional part that was not taken up. In the case of a subscription to one of our Gift Subscription packages, payment will be made in a single instalment and the subscription will not be renewed on expiry.
GASTRON'HOME, apart from the Prepaid Subscription service, will allow the delivery of certain boxes available in the rest of its Online Shop, without having the character of a regular subscription: previous versions of The Gourmet Box, boxes with specific themes and/or products sold separately (those which make up The Gourmet Box). This service will be duly advertised on the web, and your purchase will be totally independent from the other existing modality (Prepaid Subscription), not having in any case the character of a recurring subscription. To subscribe to this unique service, you must proceed as described in the sections referring to the cancellation and refund period.
Customers who request this will receive the electronic invoice for their purchase in PDF format to the email address they have provided.
In case of damage or loss of the goods, the Client must indicate at the time of delivery and in writing on the delivery note what these damages or losses consist of (the Client must verify the good condition of the package with the carrier who, on behalf of GASTRON'HOME, delivers the ordered product). Otherwise, it is assumed that the goods have been delivered correctly.
If the damage or loss is impossible to assess at the time of delivery, a written claim must be made to GASTRON'HOME within a maximum of 14 calendar days and it must be proven that the damage or loss is attributable to GASTRON'HOME SL.
In order to proceed with the processing of claims for damage or breakage under any form of contract, it will be essential for the Customer to keep the packaging of the damaged goods and their presentation to carrier personnel.
RIGHT OF WITHDRAWAL. RETURNS CONDITIONS AND PROCESS
All products purchased on the Site can be returned and refunded, provided that the Customer informs GASTRON'HOME of his intention to return the products purchased within a maximum period of fourteen ( 14) calendar days from the date of delivery, and provided that the other conditions set out in this section are met.
GASTRON'HOME will only accept returns that meet the following requirements:
The product must be in the same condition in which it was delivered and must retain its original packaging and labeling,
The shipment must be made using the same packaging and the same box in which it was received to protect the product. In the event that the reshipment could not be done in the packaging or the box with which it was delivered, the Customer must return it duly packaged so that the contents of the box arrive at the GASTRON'HOME warehouse,
A copy of the delivery note must be included in the package, where the returned products and the reason for the return will also be indicated.
To proceed with a return, the Customer must follow the following steps:
Inform within fourteen (14) calendar days of receipt of the box that the box wishes to be returned. The information must be provided by email to firstname.lastname@example.org.
GASTRON'HOME will inform the Customer of the address to which the box should be sent.
The Customer must send it by the carrier of his choice. Return costs must be borne by the Customer, unless the reason for the return is attributable to GASTRON'HOME (the product is defective), in which case the return amount will be refunded.
Inform the transport company used, the date and time of return.
If the reason for the return is a manufacturing defect of the product and it is not possible to replace it, GASTRON'HOME will inform the Customer and proceed to the payment of the proportional amount corresponding to the product in relation to the total amount paid for the service during that month. GASTRON'HOME will also reimburse the Client for the shipping costs of this incident.
In the event that the return is not due to a product defect but to the exercise of the Client's right of withdrawal, the Client will bear the direct costs of return and will be responsible for the decrease in value of the returned goods due to the handling of the goods.
The return of the sums paid will be made as soon as possible and, in any case, within thirty days of receipt of the box in the warehouses of GASTRON'HOME.
In any event, the Client will not bear any costs that may result from such a refund.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to the delivery of:
Products which do not allow their return for reasons of hygiene or health protection if they have been unsealed by you after delivery, or which are, after delivery, inseparably mixed with other products;
Products that may deteriorate or expire quickly (e.g. foods or products with an imminent expiry date);
Goods made to customer specifications or clearly personalized;
-Alcoholic beverages whose price was agreed at the time of the order and which cannot be delivered for 30 days, and whose actual value depends on fluctuations in the market which we cannot control
PRICES AND AVAILABILITY
The price of your order will be the one indicated on the web, except in case of obvious error. The Services will be billed at the price in effect at the time of registration of the order.
Service prices include VAT and other taxes that may be legally stipulated at the time of order registration. Shipping costs are the responsibility of the User and are calculated automatically according to three criteria: the country of destination, the number of boxes ordered and the shipping option chosen. They are always and expressly detailed throughout the purchase process and can be reviewed before finalizing the order.
Prices for our Services are subject to change at any time, without such changes affecting orders for which we have already notified you of an Order Confirmation. GASTRON'HOME reserves the right to modify its prices at any time. Similarly, GASTRON'HOME has the right to conduct, during defined intervals of time, promotional campaigns to promote the registration of new members to its service. GASTRON'HOME reserves the right to modify the Conditions of application of the promotions, to extend them, or to proceed with the exclusion of part of the participants in the promotion in the event of the detection of any anomaly, abuse or unethical behaviour in their participation.
GASTRON'HOME SL informs the Customer that the number of available boxes is kept up to date with the available stock and availability of our suppliers. Under no circumstances will GASTRON'HOME SL intentionally sell more units than are available. GASTRON'HOME SL will do its best to satisfy all its customers in the demand for its boxes. However, on occasion and for reasons beyond the control of GASTRON'HOME SL, such as human error or incidents in computer systems, it is possible that the amount finally served by the supplier may differ from the order placed by GASTRON'HOME to satisfy the orders of the Clients.
If one or more of the boxes ordered are not available, GASTRON'HOME, S.L. undertakes to inform the client as soon as possible. The client's order will therefore be cancelled and the amount paid, duly refunded.
MEANS OF PAYMENT
The means of payment are: Credit or debit card, PayPal or bank transfer. The use of third party data and payment methods is not permitted.
In the case of a bank transfer, the order will be considered to have been placed and will be confirmed by e-mail when we receive the transfer to the bank account of GASTRON'HOME, S.L. (Bank: CaixaBank / IBAN: ES39 2100 3339 5822 0019 9520 / BIC: CAIXESBBXXX). The Customer must send the payment receipt to email@example.com, and the order will be sent after verification of the correct receipt of payment on working days ( within 24 to 72 hours). Payment will be charged upon conclusion of the service contract. In the event of refusal of payment by the bank, GASTRON'HOME SL may terminate the contractual relationship and suspend the execution of the order, informing the Customer. GASTRON'HOME SL reserves the right of ownership of the goods ordered by the Customer until confirmation of full payment of the order.
The proof of purchase corresponding to the order will be available and can be viewed on the website in the "My Account" section. The Customer who wishes to receive an invoice must specify this when requesting subscription to the service. GASTRON'HOME undertakes to deliver the product in perfect condition to the address indicated by the Customer and which, in any case, must be located in one of the countries possible delivery of its services. In order to optimize the delivery process, the address indicated by the Customer must be an address to which delivery can be made during normal working hours (Monday to Friday from 9 a.m. to 6 p.m., excluding public holidays in the city of origin and destination). GASTRON'HOME will not be liable for errors or damage caused by delivery when the delivery address entered by the Customer does not correspond to the place of delivery desired by the Customer. Shipments are delivered to the address provided by the Customer. Delivery times may be affected by organisational causes of the carrier depending on the destination. Delays in delivery may not be considered to be due to the absence or change of address of the Client, an unknown address, closure for holidays, delays in the second or subsequent delivery attempt, force majeure or unforeseen circumstances, or any other factor not attributable to GASTRON'HOME SL. The approximate delivery times depending on the service contracted are, depending on the country of delivery indicated by the client, from 1 to 6 working days after the payment of the Service, except in exceptional circumstances or specific date indicated by the client during the ordering process, to 1 working day ready. Details of delivery charges and delivery times depending on the country of delivery chosen are set out in the footer of the website under the heading "Delivery Charge Schedule".
Delivery shall be deemed to have taken place from the moment the product has been made available to the Customer at the delivery location indicated by the Customer. Delayed delivery shall not be deemed to have occurred in cases where the order has been made available to the Customer by the transport company at the address indicated and within the agreed time limit but could not be delivered for reasons attributable to the Customer.
Unless otherwise stated on the website, estimated delivery times are estimates only. Delivery times are not guaranteed and therefore cannot be taken as 100% sure.
GASTRON'HOME undertakes, within the framework of the Delivery Service by carrier, to carry out a series of follow-up actions aimed at ensuring delivery of the order. The price of the service includes delivery notices. In case of exhaustion of delivery attempts (variable according to the country of delivery and the delivery service contracted), an additional cost will be generated to make a new delivery (at the customer's expense). It is therefore very important that a contact person is available at the address on the specified delivery date.
If, at the time of delivery of the order to the indicated address, the Customer is absent, the carrier will leave a notice or send a message by SMS or email indicating the march follow to arrange a new delivery within five (5) days. If, after seven (7) working days from the date of the notice, the Customer has not contacted the carrier to set a new delivery date, the products will be returned to the warehouses of GASTRON'HOME SL and the Customer will be responsible for the shipping and return costs, as well as the associated handling costs.
If the reason for non-delivery is due to the loss of the package, our carrier will initiate an investigation. In these cases, the response times of our carriers are generally between one and three weeks.
APPLICABLE LAW AND JURISDICTION
These General Conditions of Use are subject to Spanish law. The parties, waiving their own jurisdiction, if possible, submit to the Courts and Tribunals of Barcelona (Spain). The applicable law is Spanish law.
GASTRON'HOME reserves the right to make changes to its website. The client is subject to the Terms and Conditions in force at the time of placing your order, unless, by law or at the request of public authorities, we are required to make a modification to these terms and conditions (in which case, such modifications may apply to any order you have previously placed). If any of these terms and conditions are declared invalid, void or ineffective for any reason, that term or condition shall be deemed to be excluded without such declaration affecting the validity or enforceability of the remaining terms and conditions.
GASTRON'HOME wishes to inform its Clients and Users that it is aimed exclusively at a public over 18 years of age (the Client must be of legal age to purchase alcoholic drinks). RESPONSIBILITY FOR THE SERVICE PROVIDED
GASTRON'HOME is not responsible for any direct or indirect and/or immaterial damages, including personal injury, suffered as a result of the use of the services, loss of reputation, image or data, which may occur during the use of the services. The products that make up the Gourmet Box subscription packages and those offered in The Boutique have been certified and have passed all the relevant sanitary controls, in order to be made available to the general public, any damage caused by them must be claimed directly from the manufacturer, denying any responsibility of GASTRON'HOME in this regard. In particular, GASTRON'HOME cannot be held responsible for any allergic reactions that the products may cause. It is the User's responsibility to take into account the preferred consumption dates, duly indicated on the label, of each of the products that make up the Gourmet Box sets.
GASTRON'HOME cannot be held responsible for any failure or delay in the performance of any of its contractual obligations due to events beyond its control (force majeure). Force majeure is defined as any unforeseeable and exceptional situation or event, or any event beyond the control of the contracting parties and in particular (without limitation) the following: strikes, lockouts or any other industrial action. Civil commotion, riots, invasions, terrorist attacks or threats of terrorist attacks, war (declared or not) or threat of war. Fires, explosions, storms, floods, earthquakes, landslides, epidemics or other natural disasters. Inability to use rail, sea, air, land or road transport or any other means of public or private transport. Inability to use public or private telecommunications networks, and the laws, decrees, regulations or restrictions of any government.
CESSION OF RIGHTS AND OBLIGATIONS
The User may not cede and/or transfer the rights and obligations related to the present General Conditions or to the purchase of products and/or services through the Website, without the express and prior written authorization of GASTRON'HOME SL. GASTRON'HOME SL may freely cede and/or transmit, at any time and without the authorization of the User, the rights and obligations related to these General Conditions or to the purchase of products and/or services through the Website.
All communications between GASTRON'HOME SL and the User relating to these General Conditions or the purchase of services through the Website will be in writing and in accordance with the communication procedures established in these General Conditions for each particular case. In all other cases not expressly regulated in these General Conditions, the communications that the User intends to send to GASTRON'HOME SL will be sent to the address email@example.com and will be done in writing and through a system that allows the content and receipt by GASTRON'HOME SL of the corresponding communication to be accredited.
EXHAUSTIVENESS OF THE GENERAL CONDITIONS
These General Conditions of Use and the Contract entered into by the Client with GASTRON'HOME SL constitute the express and sole will of the Client and GASTRON'HOME SL in relation to its object and cancel and replace any other agreements or Contracts, verbal or written, previously entered into by the parties. Any modification of the Contract that documents the provision of the Services must be made in writing and by mutual agreement between the Client and GASTRON'HOME SL.
